Personal Information

Personal Information is any information we could potentially collect from you engaging with our content across media platforms.

We share some of your Personal Information with third-parties. This information includes, but is not limited to, using your Device Information to screen for potential risk and fraud (in particular, your IP address), generate analytics (for our use and for affiliates, sponsors, and friends of the channel), assess the success of our affiliates, sponsors, and partners when working with maliceincandyland.com, and assess the success of our own marketing and advertising campaigns.

We also use Google Analytics to help us understand how our audience uses the website. You can read more about how Google uses your Personal Information at https://www.google.com/intl/en/policies/privacy/.

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Please note that we do not alter our website’s data collection and use practices when we see a Do Not Track signal from your browser.

Plugins

Data may be collected by third-party plugins if you choose to use them. We only use a minimal amount of plugins so that you can avoid most of them if you choose. We use Polylang by WP SYNTEX to make it possible to switch to Spanish versions of the webpages, Blog Designer by Solwin Infotech for the Archives sidebar on the blog, PayPal Donations by Tips and Tricks HQ for processing donations, WPForms Lite by WPForms for contact forms, Call to Action by SiteOrigin to link to our form for joining our newsletter, Newsletter by The Newsletter Plugin for joining the email list when you fill out the newsletter optin, and Social Media Buttons by Space X-Chimp for buttons linking to our social media, YouTube, podcast, and blog (the buttons on the right-hand sidebar). If you don’t want these plugins to collect your data, simply do not click on them. Instead, our email and social media handles are listed in the Contact section.

Additionally, we use Cookie Notice by dFactory to ask permission to use your cookies. Clicking Understood on our cookie banner is required because we are legally obligated to get your consent for collecting your cookies (under The General Data Protection Regulation).

Comments

When visitors leave comments on the website, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string, to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available at https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. That’s because visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our website, you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me,” your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Embedded content from other websites

Content on this website may include embedded content (videos, images, articles, et al.) and links.

Links direct you away from this website and you are then subject to the privacy policies of other websites.

Embedded content from other websites behave in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Analytics

We collect demographic information and engagement activity for marketing purposes. This includes, but is not limited to, where you visit the website from, how often you visit the website, how often you click on advertisements, and which links you click on. This information is shared with third-party affiliates (and any plugins or widgets they use), sponsors (and any plugins or widgets they use), and friends of the channel (and any plugins or widgets they use) to monitor how many people are engaging with the website, where they’re accessing it from, and what they’re interested in on the website.

Demographic and engagement activity are shared with any potential affiliates, sponsors, or friends of the channel (and any plugins or widgets they use). Demographic and engagement activity may be shared in public speaking engagements, recorded videos, livestreams, or other public or private gatherings or content. For instance, we might show a graph comparing the percentage of domestic visits to our blog vs. international visits. It’s important data for marketing and quality control, but may also be of interest to our audience.

Demographic information and engagement activity are collected for us to (A) make sure that we’re making content that appeals to our target audience, and (B) for potential sponsors, affiliates, or friends of the channel to decide if we have an audience that is attractive to them. Furthermore, (C) they may be of general interest to our audience or people who would like to hear about our brand and what we do. For instance, on virtually any livestream on any platform, someone will inevitably ask where everyone’s watching from. They are curious about where the brand’s audience is from, and making graphs on the subject may be of interest to them and other audience members.

Email Optin

For our newsletter, we use the plugin Newsletter by The Newsletter Team. You can read about their treatment of data at https://www.thenewsletterplugin.com/documentation/subscription/gdpr-compliancy/.

When you subscribe to the newsletter, we ask for your email address, your name or a nickname, and your gender identity or you can select Prefer Not To Answer. We and Newsletter store this information, as well as your IP address. You can export this data by going to the “change your subscription” link in the newsletters.

If you make any changes to your newsletter preferences (via the “change your subscription” link), Newsletter keeps a record of that, as mandated by law (The General Data Protection Regulation). If you forward any of our emails to a friend, we and Newsletter will not keep any records of your friend’s data.

If you decide you no longer want to be subscribed to the newsletter, simply click the “change your subscription” link then click on “cancel your subscription.”

Donations

Donations can be made through PayPal. You can read their privacy policy at https://www.paypal.com/webapps/mpp/ua/privacy-full. A PayPal account is not needed and donations can be made as a Guest. PayPal donations are processed through the PayPal Donations plugin by Tips and Tricks HQ.

If you make a donation, we collect Personal Information, including, but not limited to, your name, billing address, payment information, email address, and phone number. We refer to this information as “Donation Information.”

We use the Donation Information for, but not limited to, processing your payment information, screening for potential risk or fraud (in particular, your IP address), reporting the amount on our taxes, and bookkeeping.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time, except for their username. The website administrator can also see and edit that information.

For newsletter subscribers, we will keep your email, name or nickname, gender identity or “Prefer Not To Answer,” and IP address until you unsubscribe.

If you make a donation, we will need to indefinitely retain information including but not limited to your name, your payment information, the amount donated, and the date when you donated, for taxes and bookkeeping.

What rights you have over your data

You can opt-out of Google Analytics at https://tools.google.com/dlpage/gaoptout.

You can opt-out of targeted advertising from Google at https://www.google.com/settings/ads/anonymous.

Another way to opt-out of targeted advertising is by visiting the Digital Advertising Alliance’s opt-out portal at http://optout.aboutads.info/.

If you are a resident of a country in the European Union and have an account on this site, have left comments, or made a donation, you can email us a request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
